The Supreme Court's Initiative: to reduce the burden on bankruptcy courts

The Supreme Court of the Russian Federation initiated amendments to the bankruptcy law and the Commercial Procedure Code of the Russian Federation. In accordance with the resolution of the Plenum of the Supreme Court of the Russian Federation dated December 19, 2023 No. 48, it is proposed to expand the use of documentary proceedings in bankruptcy cases through separate disputes on the inclusion of claims in the register, on the distribution of legal costs, etc., as well as to increase the minimum threshold of creditors’ claims to 2 million rub. (RUB 3 million for special entities).

These changes are aimed at reducing the load on commercial courts and, as a result, improving the quality of administration of justice in bankruptcy cases.
